Unfortunately, the title of the present article doesn’t convey anything good and positive as it may seem at the first sight. For the last three months four death cargo have arrived (and are still arriving) to Mariupol. In other words, the bodies of four seafarers have been delivered.
All the seafarers have died in different parts of the world, and the only thing uniting them is Mariupol.
I’ll dwell in detail on the sums of compensation, as it is my main specialisation.
Taking into account that all the seafarers have signed different contracts and worked aboard different vessels, the sums of compensation are expected to be different too. Some families have already been offered the compensation.
Somebody will get $100 000, and somebody only $30 000. To some families nothing at all has been proposed yet.
Judging by the documents I had access to, I can say the following: even if a small sum of compensation has been offered, or nothing was offered at all- it doesn’t mean that the family is not entitled to claim the increased sum.
A number of factors can effect on the sum of compensation:
- Age
- Reason of death
- Circumstances of death
- Presence of dependent relatives
- The country of the accident
- The degree of guilt from the side of the ship owner
The presence of the above factors can considerably increase the sum of compensation even if the family has already been offered $100 000.
