ITF agreements sometimes just hinder

Для любого моряка кроме основной цели – уйти в рейс, есть и другая цель – уйти в рейс на хороший контракт.

Гарантией того, что контракт хороший, моряки считают наличие коллективного договора ITF на судне, на которое они трудоустроены. И отчасти моряки правы. Правы с точки зрения некой гарантии для них оплаты труда по ставкам ITF или оплаты компенсации по ставкам ITF.

Cases when a marine lawyer is needed

The purpose of the present article is to construe to the seafarers what type of the legal expert is the marine lawyer and under what circumstances he should be hired. As well as to explain the difference between the marine lawyer and other types of lawyers.

There is a wrong stereotype that if either a seafarer or his family face any problems, they should obligatory hire merely marine lawyer. It’s completely wrong.

There are various problems. In the present article I want to dwell upon some of them, and also to explain what type of legal expert is needed in each particular case.

Arrest of the Ukrainian seafarers: trafficking of the illegal immigrants is strictly punishable

Recently the topic of the Ukrainian seafarers’ arrest for trafficking of the illegal immigrants has reached almost the highest point of its resonance in Europe. Huge imprisonment terms for the Ukrainian seafarers are really shocking from the point of view of ordinary, juridically illiterate person. They are deprived of liberty for hundreds years, which merely can’t be comprehended by an ordinary person. But from the juridical point of view, however, these terms are completely reasonable. Let’s consider for example Italy and Greece, which are the epicenter of detentions of the Ukrainian seafarers.

Speaking about Italy, it should be pointed out that in comparison with Greece, it’s legislation in respect to the imprisonment terms is rather loyal.

Sad statistics concerning the employment

I decided to derogate a little bit from the compensation due to injury topic and to write an article on the return of money from the crewing companies, illigal mediators.

If to take the matter seriously, you can see that 90% of all Ukrainian seafarers paid money for their employment at least once in their lives. Many people pay all their life long for the employment, and many sometimes overpay for the opportunity to go to the sea right here and right now.

Moreover, for the opportunity to go to the sea for the first time as a cadet without due wages, the seafarers are prepared to pay several thousand dollars.

In no case I’m going to judge whether it is good or bad, however, if the seafarers are ready to pay for the employment, the present situation will go on and on.

It’s important for the service to have been paid, to be duly done, but unfortunately it’s not always so.

The specific of work on the tankers. If it is risky?

Some young seafarers consider the tankage to be something special and outstanding, a place where great salaries are being paid if to compare with the dry-cargo vessels, a place where a substantial experience from the very start can be gained, as well as a much higher social status. Moreover, as the seafarers see it, if you have been on the tanker, you would not be scared of any kind of labour any more, because it goes without saying that you are required, because you are the genuine elite.

How to go to the sea or a manual for the purchased diplomas

The present article is a little bit unusual for me, but I’ll try to handle it. It’s not a secret that many “seafarers” have purchased their diplomas and are eager to conquer the seas and the oceans.

I’m not going neither judge nor accuse the rightness and lawfulness of such diplomas purchasing. It’s not a topic for discussion up to now. We’ll talk about the opportunities of going to the sea for the first time by this means.

It’s important to realize, that rank and file from Ukraine is not so much required there. Why so? There are various reasons: alcohol abuse, violation of labour discipline, ignorance of language etc. As well as trivial – the Philippines are much cheaper than the Ukrainians.

If the seafarers have any chance?

I’d like to hold on a little bit on the situation with the arrest of the vessel “Lady Boss” in the Spanish harbour with Ukrainian seafarers aboard.

I’ll remind you the situation. During the inspection aboard there were found 600 sacks of cannabis, total weight 18 tonnes.

It’s a clear thing, that the whole crew has been detained and presently the crew members’ relatives are attempting to call for our International Affairs Ministry as well as for everyone who is able to assist in rescuing of the Ukrainian seafarers from Spain.

As my practice shows, there is a chance to be released, but not everyone has it.

Legal aid from the marine lawyer

All my practice long I have heard dozens of times stories from the seafarers about their relatives who have graduated from law faculties or have been involved in public prosecution office, stories about their being the same lawyers as the others and therefore they are capable to provide the same efficient assistance.

But in fact, the reality was quite different and the seafarers remained without both compensation and any chance to getting it. Why so? All of them are supposed to be equal lawyers.

Elisions of crewing companies

Extremely rare I write about the crewing and almost never take part in the ” warfairs” against the employment mediators, but I’m noticing an unwelcome tendency.

Almost at each conference the crewing companies’ heads extremely passionately try to prove that they always stand on the seafarer’s side, and if the seafarer has been abused, crewing is the first to help and stretch the assisting hand.

That’s why I would particularly like to dwell on this very brotherly help and stretched hand.
